By Registering,  you acknowledge you have read and accept the waiver below

Waiver of Liability, Assumption of Risk and Indemnity Agreement

In consideration of being permitted to participate in the Learn and Hike  (“the Event”), you, on behalf of yourself, your heirs, personal representatives and assigns, release, waive, discharge and covenant not to sue the Ocean City Beach Citizens Council or Ocean City Jazz Festival, its officers, employees, volunteers and agents from liability for any and all claims relating to or arising from your participation in the Event, including but not limited to claims arising from the negligence of Ocean City Beach Citizens Council or Ocean City Jazz, its officers, employees, volunteers and agents, resulting in personal injury, accidents or illnesses (including death), and property loss.

You certify that you are physically fit, have sufficiently prepared or trained for participation in the Event, have not been advised not to participate by a qualified medical professional, and that there are no health-related reasons or problems which preclude your participation in the Event. You understand that participation in the Event carries with it certain inherent risks of injury or death that cannot be eliminated regardless of the care taken and assume all such risks arising from participation in the Event.

You further agree to INDEMNIFY AND HOLD HARMLESS Ocean City Beach Citizens Council or Ocean City Jazz., its officers, employees, volunteers and agents, from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees, arising as a result of your involvement in the Event and to reimburse them for any such expenses.

You further expressly agree that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the laws of the State of North Carolina and that if any portion is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

You consent that photographs, videotapes or films (“media”) may be taken of your person and grant Ocean City Beach Citizens Council or Ocean City Jazz and its agents and such other persons as Friends may designate from time to time, the unrestricted, right to use, reproduce, communicate, modify and display the (“media”) (in whole or in part) in any medium and for any purpose, without further notification or permission and without any fee or other compensation, for the promotion and benefit of Ocean City Beach Citizens Council or Ocean City Jazz including use of the media in creating merchandise for sale, the proceeds of which shall go to support Ocean City Beach Citizens Council or Ocean City Jazz

If the Event participant is under the age of 18, “you” means both the participant and their parent or guardian authorizing their participation.
